a.               1163 E. Parkhaven Drive, Janet Burns

A 24’ variance to Ordinance No. 931.04(b) Residential Fence Regulations to allow the proposed 6’ high vynal fence to be 24’ forward of the rear building line as depicted on the submitted drawings.  Ordinance 931.04(b) does not allow  a wall, fence, trellis, or other type structure to be constructed or maintained between the rear yard building line and the street line on any lot in any Use District in the City.

b.               4265 Chestnut Rd., Greg & Lisa Edwards

A 2’ variance to Ordinance No. 909.04(2) Development Standards for the Residential (R) District, Side Yard Setback, and a variance to 919.03(d)(3) Residential District, Accessory Building and Structure Height, to allow the replacement of the existing detached garage to be 3’ off the side yard lot line with a height of 20’ as depicted on the submitted drawings.  Ordinance  No. 909.04(2) specifies that no interior side yard on the side on which a garage is located be less in width than five feet. Ordinance No. 919.03(d)(3) states that an accessory detached garage shall not exceed a maximum height of fifteen feet.

            Variance requests may be amended or deviated from that which appears above. 

            The Board will first hear testimony of the applicant for the variance.  Thereafter,

            the Board will allow interested parties to be heard on the subject of the public hearing.
